Human Rights & Employment Law Litigation:

Romain Law has experience working with both employers and employees in workplace matters. Representing both sides of the employment law dispute provides us with a different perspective that allows for the development of a winning strategy that understands the opponent and the way that they think.

We regularly provide assistance and advice on the preparation and negotiations of employment contracts, termination and severance packages, and either side of wrongful dismissal and Human Rights claims.

Courtroom Experience

Our experience in the courtroom has armed us well to fight for employees who have been discriminated against, wrongfully dismissed, or are the target of negligent workplace investigations that lead to their unjust dismissal. A strong background in criminal defence litigation has also equipped us with skills and experience to defend good employers against false and exaggerated claims by former employees.

We assist management solve their employment issues including problematic employees, Employment Standards Act compliance, and navigating issues in their workforce including workforce investigations.

Nearly two decades of experience evaluating the conduct of professional investigations conducted by detectives in criminal prosecutions has prepared us well for work in workplace investigations.  

Workplace Investigations for Employers

Our investigations mitigate risk by providing effective and efficient workplace investigations when outside impartial investigations are appropriate. We conduct workplace investigations in a variety of workplace-related matters including:

•    employee misconduct including investigations of allegations of assault, theft, and fraud investigations; 
•    harassment and bullying; 
•    allegations of discrimination;
•    workplace accidents; 

Representation of Employees Under Investigation 

In addition to conducting workplace investigations, we also help Employees who are being investigated by their employers, witnesses and complainants during the workplace investigation.    

Workplace investigations can be extremely stressful for someone who is being wrongfully accused of employee misconduct. Workplace investigations also pose a danger that criminal charges or professional regulatory proceedings may follow.  

Our experience in both employment law and criminal law situates us well to assist employees who are being investigated by their employers for conduct that may also result in criminal charges. While a suspect in a criminal investigation has the right to remain silent, the same is not true in the employment context. Our firm helps employees walk that fine line so that they can participate in their employer’s investigation (and keep their job) while reducing the risk of providing evidence (including statements) that can be given to the police and used against them later in criminal prosecutions.
